Who We Are

Motiofy Inc. ("Motiofy", "we", "us", or "our") is based in the United Kingdom. This Privacy Policy explains how we handle personal information when you use Motiofy's websites, applications, AI creation tools, and related services (collectively, the "Service") anywhere in the world.

Age Requirement

The Service is intended only for people aged 18 or older. Do not use the Service or provide personal information if you are under 18.

Information We Collect

We collect information needed to operate the Service:

1. Account and authentication information. If you sign in with Google or Google One Tap, we receive the account details Google makes available to us, such as your name, email address, profile information, and Google account identifier. We also create account and session records.
2. Creative content. We process the prompts, uploaded materials, generation settings, and images or videos you create or generate through the Service (together, "User Content").
3. Payment and subscription information. Stripe processes payment card details. We receive information needed to manage your purchase, subscription, credits, billing status, transaction identifiers, and receipts; we do not receive or store full payment-card numbers.
4. Usage, device, and security information. This may include IP address, browser and device information, log data, pages or features used, referral and campaign information, language preferences, and security or fraud signals.
5. Communications and preferences. We collect the contents of messages you send us and your marketing and cookie preferences.

How We Use Information

We use personal information to provide and operate the Service, authenticate accounts, generate requested content, process payments, provide support, maintain security, prevent fraud and abuse, comply with law, and improve non-model aspects of the Service.

Where UK or EEA data-protection law applies, we generally process information to perform our contract with you, comply with legal obligations, pursue legitimate interests such as security and service reliability, or with your consent when consent is required. We use consent for marketing communications and, where required, non-essential analytics technologies.

AI Processing and Model Training

To generate the content you request, we may transmit relevant prompts and uploaded materials to third-party AI service providers that process them on our behalf. We do not use your User Content to train Motiofy AI models or third-party AI models. This applies to every plan, including paid and commercial-use content.

When We Disclose Information

We do not sell personal information. We do not share personal information for third-party advertising or cross-context behavioural advertising.

We disclose only the information necessary to operate the Service to these categories of recipients:

• Google for authentication;
• Stripe for payment processing and subscription administration;
• Google Analytics 4, Plausible, and PostHog for analytics, subject to your choices and applicable law;
• third-party AI service providers to generate requested content;
• cloud hosting, storage, communications, security, and other infrastructure providers; and
• professional advisers, authorities, or other parties where necessary to comply with law, protect rights and safety, or support a corporate transaction.

These providers may process information in countries outside your country of residence. Where applicable law requires it, we use appropriate transfer mechanisms and safeguards for international transfers.

Cookies and Analytics

We use strictly necessary technologies for core functions such as security, sessions, and remembering your choices. Where applicable law requires consent, we will not enable Google Analytics 4, Plausible, PostHog, or other non-essential analytics until appropriate cookie controls are available.

Once those controls are live, you will be able to accept, reject, or later change non-essential analytics choices. Rejecting analytics does not stop you from using the Service. Read our Cookie Policy for the technologies we use and the current rollout status of these controls.

Retention and Account Deletion

Free-plan uploaded materials and generated content are normally retained for up to 14 days. Content associated with a paid subscription may be retained while your account or relevant subscription entitlement remains active.

When you request account deletion, we immediately disable account access and delete your original uploaded materials and generated content within 30 days. We may retain billing, tax, fraud-prevention, security, and legal-compliance records for as long as required or permitted by applicable law.

Your Privacy Rights

Depending on where you live, you may have rights to request access to, correction, deletion, restriction, objection to certain processing, portability, or a copy of your personal information. You may withdraw marketing or analytics consent at any time. You may also have the right to complain to a relevant data-protection authority.

Security

We use reasonable technical and organisational measures designed to protect personal information. No internet transmission or storage system is completely secure, so we cannot guarantee absolute security.

Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version here, revise the "Last updated" date, and provide additional notice where required by law.
