Acceptance and Eligibility

These Terms of Service ("Terms") govern your access to and use of Motiofy's services, websites, applications, and related tools (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. If you use the Service on behalf of another person or organisation, you confirm that you have authority to accept these Terms for them.

The Service

Motiofy provides consumer-facing AI creation tools that let you upload materials you are entitled to use and/or submit prompts to generate, transform, edit, and download images and videos. We may use third-party AI, cloud infrastructure, and payment providers to provide the Service.

We may improve, modify, suspend, or discontinue features where reasonably necessary. We do not guarantee that every feature, model, or output will always be available.

Accounts and Security

You are responsible for keeping your account credentials confidential and for activity under your account. Notify us promptly at support@motiofy.ai if you believe your account has been accessed without authorisation.

You may cancel your subscription through Settings. To request account deletion, use Settings where that option is available or contact support@motiofy.ai. Cancellation does not automatically create a refund; refunds are governed by the terms below and any rights that cannot be excluded by law. Account deletion and data retention are described in the Privacy Policy.

Your Content and AI Outputs

"Input" means material, prompts, and other content you submit to the Service. "Output" means material generated by the Service from your Input.

You retain the rights you hold in your Input. You grant Motiofy the limited rights needed to host, process, transmit, and use your Input to provide, secure, maintain, and improve the Service. This permission does not include training AI models: Motiofy does not use your Input or Output to train Motiofy AI models or third-party AI models.

Outputs generated under the free plan are licensed for personal, non-commercial use only. If you generate Outputs while on a paid subscription, Motiofy grants you a non-exclusive licence to use those Outputs for commercial purposes, subject to these Terms and your rights in the Input.

AI-generated Outputs may not be unique, accurate, appropriate for your purpose, or free of third-party rights. You are responsible for reviewing Outputs before use and for ensuring that your Input and use of Outputs comply with applicable law and third-party rights.

Motiofy and its licensors retain all rights in the Service, including its software, branding, and underlying technology, except for the limited rights expressly granted to you.

Acceptable Use

You must not use the Service to:

• break the law or violate another person's rights, including intellectual property, privacy, or publicity rights;
• upload material you do not have permission to use;
• create, distribute, or facilitate fraud, impersonation, deception, malware, spam, or unauthorised access to systems;
• create or distribute sexual content involving minors, exploitative sexual content, or other unlawful harmful material;
• interfere with, probe, or circumvent the Service's security, limits, or access controls; or
• use the Service in any way that could harm Motiofy, other users, or third parties.

We may investigate violations and suspend access, remove content, cancel subscriptions, or terminate accounts where reasonably necessary to enforce these Terms or protect the Service and its users.

Billing, Trials, and Refunds

Paid plans and credits are billed in advance under the price and billing period shown at checkout. Subscriptions renew automatically unless you cancel before the next renewal date. Any credit-specific terms displayed at purchase form part of these Terms.

Free trials. If a free trial is offered, you may cancel at any time during the trial without charge. Unless we state otherwise at checkout, the subscription will begin charging at the end of the trial if it is not cancelled first.

Monthly plans. Monthly subscriptions are generally non-refundable for partial months once the billing cycle has begun, except where required by law.

Annual plans. Annual subscriptions are eligible for a pro-rated refund if you cancel within thirty (30) days of the initial purchase or any subsequent annual renewal. The refund is calculated from the unused portion of the applicable annual subscription period. To request a refund, contact support@motiofy.ai.

One-time Credit packs. A Credit pack purchase is non-refundable once any Credits from that pack have been used. To request a refund for a completely unused Credit pack, email support@motiofy.ai from your account email and include the payment details. Requests are reviewed manually and approval is not guaranteed, except where required by law. Motiofy does not provide a self-service refund option.

Third-Party Services

The Service may connect to or depend on third-party providers. Their services and terms may apply in addition to these Terms. Motiofy is not responsible for third-party services that we do not control.

Disclaimers and Liability

The Service and Outputs are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Motiofy disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Motiofy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill arising from or related to the Service. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Governing Law and Courts

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over disputes arising from these Terms or the Service, except that nothing in these Terms removes consumer protections that cannot be excluded under the law of your habitual residence.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page, update the "Last updated" date, and provide additional notice through the Service where a material change requires it. Continuing to use the Service after the updated Terms take effect means that you accept them.
